Commentary by Attorney Michael Grossman

Reading any crash about someone seriously injured because a Ford Focus rear-ended a Tacoma, I would expect the driver in the Ford to be the one who was seriously injured. That didn’t happen here. Instead, the pickup driver was apparently the one who was seriously hurt. How exactly did that happen?

Verifying the cause of someone’s injuries can be just as important as investigating the cause of an accident. It could be that details not confirmed in the preliminary reports can offer a perfectly normal, reasonable explanation for why the pickup driver was seriously injured and not the car driver.

When there isn’t a normal explanation, though, it could be a red flag the victim’s vehicle had some kind of defect. Did an airbag not go off? Did the seatbelt fail? Did the seat assembly jar loose during the crash? Did a crash avoidance system cause the vehicle to lose control unnecessarily?

Like I said, it’s possible there’s a reasonable explanation behind the scenes for the vastly different outcomes the drivers experienced. But if there isn’t one, then it’s possible there’s more to this crash which isn’t getting the attention it deserves.
