Commentary by Attorney Michael Grossman

It sometimes surprises folks to learn that drunk driving crashes are more common at 7:00 p.m. on a Saturday than at 2:00 a.m. on a weekday. One reason for that is all these people have free time and usually nothing to do the next day, so they go out and blow off steam. Local alcohol providers are all too happy to take advantage of this, break the law, and over-serve people as much as possible to pad their bottom line. After serious accidents, though, one rarely hears about any consequences for those reckless establishments. Drunk drivers obviously deserve to be held accountable, so why wouldn’t the same be true for the negligent alcohol providers that illegally over-served them?

Simply put, I’ve seen first hand how fast alcohol providers clean up their act after facing consequences like criminal charges, fines, personal injury claims, or license suspensions. Each alcohol provider put on the straight and narrow is another establishment no longer putting lives at risk. That’s why, after these kinds of accidents, there should always be consideration that the drunk drivers may not be the only ones in need of a wake up call.
