Commentary by Attorney Michael Grossman

When a crash involves a passenger vehicle losing control and being struck by a semi-truck, the key question is why did the car spin out in the first place? At first glance, it may seem like an unavoidable accident, but experience tells me that several factors could have contributed to this deadly collision.

Ano important factor to consider is whether external forces contributed to the spin-out. Did another vehicle cut off the Chevrolet, forcing the driver to overcorrect? Was there debris or uneven pavement that caused a loss of control? Dashcam footage from the semi-truck, along with traffic cameras and witness statements, may help determine if another factor triggered the car’s loss of control.

It’s also worth looking at whether the truck had enough time to react. Large commercial vehicles need more distance to stop, and a car spinning into their path leaves little room for avoidance. However, speed and following distance should still be examined to ensure the truck driver was operating safely for conditions.

At this stage, we don’t have enough information to say exactly what caused this crash. But what is clear is that this is more than just a case of a car losing control. Investigators should go beyond the crash scene and examine weather conditions, roadway safety and any outside factors that could have contributed to this collision. If they don’t, they risk overlooking key details that explain what really happened.
