Commentary by Attorney Michael Grossman
People tend to see crashes like this—one driver being blamed for a blatant mistake—and they think everything is open-and-shut. However, it’s important investigations are always thorough to catch possible extenuating circumstances. For example, it stands out to me that only one person had reported serious injuries here. Let me explain why.
Generally speaking, when two vehicles of comparable size collide, people will suffer similar injuries. It’s not always equal, and sometimes situations put one person more in harm’s way, but that’s generally how things go. So if one person is in serious condition, but everyone else is okay, it’s sometimes a sign that something meant to protect that person failed to do so.
As such, did authorities inspect the victim’s vehicle here? Did the airbag go off? Did the seatbelt lock properly? Was the seating assembly jarred out of place? Did the Honda not hold up to the impact the way it should have? Likely or not, these are the kinds of possibilities that make careful accident reconstructions so important. It’s better to rule out something uncommon than to miss something important.
