Commentary by Attorney Michael Grossman

When people hear about a crash like this one, they might quickly assume it’s a simple case of one driver not paying attention. In my experience, the reality is often more complicated, especially if this was a commercial van. Let’s explore the critical questions that need to be answered to understand what really happened.

First, why did the van driver attempt a left turn at an unsafe time? Was the driver distracted or in a hurry? Did they misjudge the speed or distance of the oncoming motorcycle? Understanding the driver’s state of mind and actions leading up to the crash is crucial.

Next, we need to consider the possibility of mechanical issues. Was the van in good working order? Were there any mechanical failures in the van that could have contributed to the crash? Mechanical inspections can provide valuable insights.

Again assuming the van was part of a commercial company, the role of the van driver’s training and experience is another factor to consider. Was the driver adequately trained and familiar with the vehicle’s operation? Did the driver have a history of traffic violations or accidents? The van driver’s record and training could reveal whether this crash was part of a pattern of risky behavior.

Lastly, if the van is part of a commercial organization, it should be held to the same standards as any commercial fleet. This means examining the company’s safety protocols, driver training programs, and maintenance schedules. Are they enforcing strict maintenance schedules and safety protocols? If the company cut corners on training or vehicle upkeep, that negligence could have played a significant role in this crash.

To get to the truth of this crash, a thorough investigation is essential. This means looking beyond the immediate scene to gather all relevant evidence, including vehicle data, maintenance records, and potential witness accounts. Only by piecing together all these elements can we determine the full story and hold the appropriate parties accountable.
