Commentary by Attorney Michael Grossman
Authorities suggest that a witness saw Bradshaw crossing the street, so that brings up the question: why didn’t the driver? It’s important to ask because regardless of things like right-of-way (as important as that is), drivers generally have a responsibility to avoid an accident if reasonably possible. For example, if someone is in the middle of the road but clearly visible and far away enough for a driver to avoid, they need to avoid the collision. If there was no way the driver could see and avoid the victim, it would be ridiculous to punish them for that. Have authorities been able to determine exactly how avoidable this was?
