Commentary by Attorney Michael Grossman
When two vehicles traveling in the same direction collide on a highway, especially when one person is left seriously hurt, it’s often a sign that something went wrong beyond just a moment of misjudgment. Understanding how and why it happened takes more than a brief description—it takes a deliberate investigation.
1. Did investigators have the time, training, and equipment to fully examine the crash?
Same-direction collisions can be complicated. Was there a sudden lane change? A loss of control? Did either driver attempt to avoid the collision? Without a full scene analysis—including vehicle positions, speed estimates, and road conditions—it’s easy to overlook what caused the vehicles to intersect in the first place.
2. Has anyone looked into whether a mechanical or safety system failure played a role?
Even in straightforward crashes, it’s possible that something failed inside one of the vehicles. Braking or steering issues, malfunctioning sensors, or safety systems that didn’t perform correctly—like seatbelts or airbags—can all contribute to the severity of the injuries. These are not details that can be assumed or ignored—they need to be verified through proper inspection.
3. Has all the vehicle data, phone activity, and nearby footage been reviewed?
Most modern vehicles record data on speed, braking, and steering input just before impact. Phone activity can help confirm timing, and nearby traffic or business cameras may have captured the crash. These sources offer crucial context that can confirm or correct assumptions in early reports.
When someone is seriously hurt and the cause is unclear, it’s not enough to accept the basics. Real answers come from a closer look—one that doesn’t leave critical questions on the table.
Takeaways:
- Same-direction highway crashes require detailed analysis to understand why vehicles collided.
- Possible failures in mechanical or safety systems must be ruled out with inspection.
- Vehicle logs, phone records, and camera footage are essential to clarify what really happened.
