Commentary by Attorney Michael Grossman
When it comes to a deadly commercial vehicle accident like this, I always take statements from the authorities with several grains of salt. To be clear, this isn’t because authorities never handle them properly, and there’s nothing about this accident specifically I can comment on. But with any commercial vehicle accident comes the inherent challenge of going up against commercial interests which have one priority: avoid as much responsibility as possible. Having handled hundreds of cases against such commercial interests, anticipating and dealing with their efforts is something that the average person and even a lot of officers just aren’t prepared to handle.
For example, a complex issue surrounding many commercial truck wrecks is that there is often a representative from the truck driver’s company at the scene as soon as possible ready to coach drivers on what to say (or not say) as well as speak with the investigators as early in the investigations as possible. I’ve even had situations where a company flew a defense attorney to a crash scene in a helicopter, getting them to the crash site before even all of the emergency personnel called to the scene could arrive. By doing this, these representatives can help paint their drivers in as positive a light as possible and even influence officers to consider factors that work in their favor before investigators have even looked at the evidence.
Even if those representatives don’t lie or tamper with evidence, they tip the scales against the victims and the families who usually just want to know they’re getting the truth about what happened. Restoring balance to the equation usually requires a significant amount of experience, clear evidence, and legal maneuvering to correct. So while I certainly don’t know what all happened surrounding this specific accident, simply knowing the kinds of vehicles involved tells me that anything short of careful and thorough investigations might end up letting something important slip through the cracks.
