Bailey County, TX — December 31, 2024, Vanessa Garcia, Joseph Garcia, and two others were injured after an alleged drunk driver accident at 9:16 p.m. along U.S. Highway 70.

According to initial details about the accident, it happened along eastbound lanes of the highway near the intersection with F.M. 3269.

Investigators said that Vanessa Garcia, Joseph Garcia, and two children were in an eastbound Buick Lucerne. An east Dodge Charger reportedly failed to control speed, and it crashed into the Buick as a result.

Due to the crash, the Dodge driver was seriously injured. Vanessa Garcia, Joseph Garcia, and one of the children in the Buick were hurt. Authorities allege that the Dodge driver was under the influence of alcohol at the time. They recommended a charge for intoxication assault.

With any crash allegedly involving alcohol, there’s a key factor to keep in mind: Was the alleged drunk driver served by an alcohol provider? This is something that too often goes overlooked, but it can have significant implications for the victims and families as well as the community as a whole. Let me explain.

In Texas, it’s unlawful for bars and other establishments to serve someone who is obviously intoxicated. Doing so exposes those alcohol providers to potential criminal investigations, fines, suspended licenses, or liability for the resulting injuries.

However, authorities don’t often investigate accidents like this beyond the alleged drunk drivers. They obviously deserve to face consequences, if deemed appropriate. But across the hundreds of alcohol-related accident cases I’ve handled, families wanted to know all responsible parties were being held accountable. If authorities haven’t looked into the possibility of a complicit alcohol provider, they may not be able to ensure that happens.
