Vanessa Carreon, Arthur Sous Car Accident in Galveston, TX

According to officials, a 37-year-old woman and a 36-year-old man from Stafford were walking at the time and reportedly attempting to cross Seawall. Down the road, officials say an eastbound Ford Explorer crashed into a Nissan Rogue that was trying to pull out of a parking spot. This caused the Ford to veer into the two pedestrians.

As a result of the collision, the Stafford woman was seriously injured while the man had moderate injures. There were no other reported injuries. At this time, authorities allege that the Ford driver was under the influence of alcohol. There was apparently an arrest, but charges are unclear at this time.

If these preliminary details are true, folks may think this is all open-and-shut. Someone was drunk driving, and they were arrested. What more is there to discuss? Well, with alcohol-related accidents, there’s often an accomplice who slips through the cracks unless there are more thorough investigations: a negligent alcohol provider.

Simply put, if an alcohol provider over-serves someone who is obviously intoxicated, they expose themselves to potential criminal investigations, fines, suspended licenses, and liability for injuries resulting from that person’s intoxication. Not only does this provide an opportunity for those establishments to be held accountable for their actions, but it’s often a way to put them on the straight-and-narrow before their behavior goes on to hurt others.

It’s not unusual for authorities to overlook this possibility, though, as their investigations tend to be narrowly focused on the drunk drivers. I’ve even had cases where we brought a negligent alcohol provider to the authorities’ attention, and they still weren’t motivated to pursue their own investigations. Maybe authorities here have been more thorough, but it’s possible there’s still more to this story which has yet to get the attention it needs.
