Tyler Smith Car Accident in Wichita County, TX

It appears that 27-year-old Tyler Dewayne Smith was in a Dodge Ram going eastbound on F.M. 367. Smith turned onto Coleman Park and traveled some distance before the vehicle apparently lost control, possibly due to slick road conditions. The vehicle ran off-road, then overturned, seriously injuring Smith. No one else appeared to have been involved.

Commentary by Attorney Michael Grossman

With a crash like this, people tend to assume there’s nothing really to discuss if something in the road causes a vehicle to lose control. But things aren’t always as simple as figuring what caused the crash. Sometimes, authorities overlook something that caused the injuries which also needs to be addressed—sometimes something even a victim didn’t know about.

For example, I handled a case not long ago where a vehicle overturned. The crash itself didn’t seem unusual, but the family found it odd that authorities accused the victim of not wearing their seatbelt. They always wore their seatbelt, so they felt the investigations were mishandled. Through further investigations, though, it turned out the victim had a defective seatbelt. It failed during the accident, causing the serious injuries that authorities mistakenly attributed to the crash.

That’s certainly not a common scenario, but it’s far from the only example of authorities overlooking important details. Their focus tends to be narrow, and it can unfairly land on victims who may in need of answers authorities aren’t looking for. Maybe nothing like that happened here, but that would be up to a more thorough investigation to say for sure.
