Commentary by Attorney Michael Grossman

While I certainly don’t know more about this incident than anyone else in the public, I often am the one cautioning folks not to jump to conclusions. I’ve seen incidents like this before where it turned out unusual or complex circumstances led to the accident which authorities never properly addressed.

For example, I handled a case a while back with details similar to this. A family wanted us to be a second set of eyes and find out why their loved one was walking on a freeway. As it turned out, he’d been out with friends at a local establishment which proceeded to illegally over-serve alcohol to him. It got to the point his intoxication put him in danger, yet the provider kept pouring drinks. The man responsibly chose not to drive and instead attempted to walk home, but he unfortunately became disoriented and wandered off the walkway and up a freeway exit ramp where a car hit and killed him.

What people had written off as just someone being somewhere they shouldn’t have been turned out to be a case of a local alcohol provider illegally over-serving someone and contributing to a fatal accident. Authorities simply never bothered to look into that possibility, so the family almost never learned the truth of what happened to the victim. I’m not suggesting that happened here, of course, but rather that it and many other possibilities are worth looking into. Even if nothing unusual happened here, there’s a family out there that deserves to know they’re getting the whole story.
