Commentary by Attorney Michael Grossman
When I hear about a crash where a vehicle pulled out in front of a dump truck, my first question is, “Why didn’t the driver see the truck, or why didn’t the truck have time to stop?” Many people might assume this is a simple failure to yield, but in my experience, intersection crashes like this often involve more than just driver error.
One key factor investigators should consider is visibility. Was the Lexus driver’s view obstructed by trees, signs or other vehicles? Some intersections have poor sightlines, making it difficult for drivers to judge the speed and distance of approaching traffic. If visibility was a factor, that’s not just a driver issue: it’s a roadway design problem that should be addressed to prevent future crashes.
Another important aspect is the speed of the dump truck. Trucks like this take longer to stop than passenger vehicles, especially if they’re carrying heavy loads. Investigators should review traffic camera footage, skid marks and ECM (black box) data from the truck to determine whether it was traveling at a safe speed for the area.
At this point, there are too many unanswered questions to say exactly what caused this crash. That’s why a thorough investigation is necessary: one that looks at not just who had the right of way, but also whether visibility, road design, vehicle speed, or driver ability contributed to the wreck. The victim’s family deserves answers about why this crash happened.
