Vega, TX — June 19, 2024, a Lubbock woman and a Rio Grande City man were injured following a truck accident at around 1:00 p.m. on I-40BL.
Initial details about the crash say it happened along Interstate 40 Business/U.S. 66 at 11th Street, just off South Main Street.

According to officials, a 46-year-old Rio Grande City man was in a Ford F-350 with a trailer. The man was reportedly perpendicular to travel lanes attempting to back off the roadway. At the same time, it’s said a 49-year-old Lubbock woman was going westbound in a Jeep Cherokee. The Jeep crashed into the side of the truck. As a result, both the man and the woman were injured.

Authorities allege that the woman had been drinking, and that probably makes this open-and-shut for a lot of people. However, I’ve litigated hundreds of commercial vehicle accident cases as well as hundreds of cases involving alcohol. Everyone agrees that drunk driving is dangerous, but there are a lot of people who would agree that blocking lanes of travel to back a trailer off the roadway can be dangerous. That potentially means there’s a legal controversy here, and it brings up an important question. If there are two people who can be blamed for an accident, how does one determine who’s at fault?
Well, there’s no magic equation. The law doesn’t say, for example, “Drunk driving is always the more serious action and is always at fault.” Instead, that’s up to juries to decide given the evidence they’re presented. They could decide alcohol is the more serious issue, or they may say a commercial driver blocking lanes of travel is more serious. Maybe people would put equal blame on both drivers. Or, maybe they’d be convinced this all falls on one person’s shoulders alone, and the other person is blameless.
That’s why I’m always so adamant about getting clear, convincing evidence. No matter the situation, the more evidence someone has telling their side of the story, the more convincing they’re going to be. What a potential jury would decide based on those stories is up to them.
