Commentary by Attorney Michael Grossman
When accidents like this happen, people often assume they are the result of simple driver error. However, based on my experience, crashes involving large trucks often have deeper, more complex causes that require thorough investigation.
In this particular incident, the fact that a commercial truck was involved adds another layer of complexity. Investigators need to examine various factors that could have contributed to the crash, such as whether the truck driver was adhering to safety protocols, including speed limits and hours-of-service regulations. Fatigue, for instance, can be a significant issue for truck drivers, especially in early morning hours. Additionally, the condition of the truck itself should be considered. Mechanical failures, such as brake issues or tire blowouts, can easily lead to a loss of control, resulting in collisions with other vehicles or fixed objects like guardrails.
It’s also important to consider the possible involvement of a commercial trucking company. If the truck was part of a fleet, the company might share responsibility for the crash, particularly if it failed to properly maintain the vehicle or enforce safety practices among its drivers. Ensuring that commercial trucks are regularly inspected and that drivers are well-trained is crucial in preventing such accidents.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
