Ellis County, TX — December 28, 2024, a woman and a man were injured following a semi-truck accident at around 3:58 a.m. along U.S. Highway 287.

According to initial statements, the accident happened near the intersection of U.S. 287 and Shady Grove Road.

It appears that a 34-year-old woman was a passenger in a semi-truck driven by a 64-year-old Fort Worth man. Their vehicle was going southeast on the highway when it reportedly lost control on the icy roads. The truck jackknifed and crashed as a result.

People are often quick to write off single-vehicle truck accidents, assuming everything just falls under the umbrella of a work accident. However, things can get more complex when one of the victims is a passenger in the vehicle. A lot depends on what the relation is between the driver and the passenger and whether or not that passenger is a co-worker.

Simply put, if a passenger in a truck is a family member, spouse, acquaintance, or some other individual not associated with the truck driver’s employer, their possible legal avenues may lie beyond the confines of a work accident. After all, if they’re not on the job, they wouldn’t be subject to job-related accident laws. This means there are some situations where a passenger in a truck has the same options available to them as someone in a separate vehicle involved in a truck wreck.

So while it’s not clear what all happened here, the preliminary information raises a few red flags suggesting this might be a much more challenging situation than a typical truck accident. Hopefully steps have been taken to ensure those involved in this accident understand their rights and have the tools and evidence needed to exercise those rights to their full extent.
