Commentary by Attorney Michael Grossman

When I read about an accident like this one involving a passenger car colliding with a parked 18-wheeler at a rest area along Interstate 495, the immediate question that comes to mind is: What circumstances led to this collision? While it might appear straightforward—one vehicle hit another parked vehicle—there’s often more complexity to these events than meets the eye.

One key area that needs investigation is whether the truck was parked properly and safely. Rest areas are designed to provide a safe place for drivers to stop, but I’ve encountered cases where trucks were parked outside of designated spaces or in areas with poor visibility. It’s critical to determine if the 18-wheeler was positioned in accordance with rest area rules and industry safety standards.

Another focus should be on the passenger vehicle. Was the driver distracted, fatigued, or impaired in some way? Was there a mechanical issue with the vehicle, such as brake failure or loss of steering? Investigators should also evaluate visibility conditions at the time of the crash. Rest areas often have limited lighting, and parked trucks without adequate reflective markings or hazard lights can be difficult to see, particularly in the early morning hours.

It’s also worth examining the condition and equipment of the parked truck. Was it outfitted with the required reflective devices and hazard lights to make it visible to other drivers? If the truck wasn’t properly marked, that could have contributed to the crash. Answering these questions is critical before assigning fault to any one party.

When an accident like this occurs, it’s important for investigators to go beyond the crash scene to uncover contributing factors. Determining whether safety measures were followed, from proper parking practices to vehicle maintenance, ensures that those involved are held accountable when necessary.

This case serves as an example of how complex the causes of a crash can be, even when it initially seems simple. By thoroughly investigating all possible contributing factors, investigators can uncover the full story and provide clarity for everyone involved.
