Commentary by Attorney Michael Grossman

When people hear about an accident involving an 18-wheeler overturning, they often assume it’s a straightforward case of driver error. However, in my experience, these incidents are rarely that simple. Accidents like these typically involve multiple factors that need careful examination to understand what truly happened and to hold the right parties accountable.

First, it’s essential to determine why the 18-wheeler overturned while making a turn. Was the driver speeding, distracted, or perhaps inexperienced? Alternatively, did mechanical issues with the truck play a role? Collecting data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements will be crucial in piecing together the events that led to this crash.

Next, the trucking company’s role must be scrutinized. Was the driver adequately trained and following safety protocols? Trucking companies have a responsibility to ensure their drivers are well-prepared for the demands of the road. If the company cut corners on training or maintenance, they might share responsibility for the incident. Reviewing the driver’s training records and the company’s maintenance logs can provide insight into these questions.

Additionally, it’s important to examine the truck’s condition. Was it properly maintained? Mechanical failures, such as brake malfunctions or tire issues, can significantly contribute to accidents. Thorough inspections and maintenance record reviews can reveal if such problems were a factor.

Investigations must go beyond the crash scene to uncover the full story. This includes looking into the truck driver’s logs, evaluating their driving history, and possibly consulting with accident reconstruction experts. Only with a comprehensive approach can we ensure that all responsible parties are held accountable.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Whether through obtaining vital evidence or, if necessary, conducting an independent investigation, it’s crucial to consider every factor to ensure clarity and accountability. This diligent approach is essential to answer the remaining questions and provide closure for everyone involved.
