Commentary by Attorney Michael Grossman
Crashes where a semi-truck overturns on a curve raise serious concerns about speed, road design and whether the truck’s cargo played a role in the loss of control. In this case, reports indicate that a semi-truck hauling trash overturned on a curve, slid into oncoming traffic and collided with a dump truck, resulting in the semi-truck driver’s death. A full investigation should determine whether this was due to driver error, improper loading, road conditions or another contributing factor.
One of the first questions investigators should answer is whether speed played a role. Curves require commercial truck drivers to reduce speed significantly, especially when carrying a full load. Was the truck traveling too fast for the curve? Reviewing black box data, skid marks and road signage will help determine whether the driver misjudged the turn or was exceeding a safe speed.
Another key factor is whether the truck’s load contributed to the crash. Shifting cargo can throw off a truck’s balance, making it more likely to tip over, especially on a curve. Was the trash properly secured? Was the weight evenly distributed? Investigators should examine loading records and conduct a post-crash inspection to determine whether cargo movement contributed to the rollover.
Road design and maintenance should also be considered. Were there adequate warning signs before the curve? Was the road surface in good condition, or were there potholes or uneven pavement that could have made it harder for the driver to maintain control? If the roadway itself contributed to the crash, that should be examined closely.
At this stage, there isn’t enough public information to determine exactly what led to this crash. But if authorities focus only on the impact without investigating why the truck lost control they risk missing key details. A thorough investigation should take all possible factors into account to ensure a full understanding of what went wrong.
