Commentary by Attorney Michael Grossman

Crashes where a vehicle collides with the back of a parked truck often raise serious concerns about visibility, road conditions, and whether the truck was properly marked. In this case, reports indicate that a Ford Explorer crashed into a flatbed crane truck that was parked in the roadway while delivering equipment. A full investigation should determine whether this was due to driver inattention, poor visibility or whether the parked truck created an unavoidable hazard.

One of the first questions investigators should answer is whether the flatbed truck was following proper safety protocols. When a commercial vehicle stops on the roadway, federal regulations require drivers to activate hazard lights and place reflective warning triangles or other safety markers to alert approaching traffic. If those precautions were not taken, that could have made it much harder for the Ford driver to recognize the truck in time to stop.

Another key factor is whether the road and weather conditions affected visibility. This crash happened in the morning, when sun glare can sometimes obscure a driver’s view. Was the truck positioned in a way that made it difficult to see from a distance? Was there fog, rain or another environmental factor that may have played a role? If visibility was limited, investigators should determine whether additional safety measures, such as warning signs or flaggers, were needed.

At this stage, there isn’t enough public information to determine exactly what led to this crash. But if authorities focus only on who hit whom without investigating why the truck was parked in the roadway and whether proper precautions were in place, they risk missing key details. A thorough investigation should take all possible factors into account to ensure a complete understanding of what went wrong.
