Commentary by Attorney Michael Grossman
When I read about this incident, it brings to mind the numerous cases I’ve encountered over the years involving intersection crashes. Many people might look at this situation and conclude that the driver of the Ford F-350 is solely to blame. However, my experience tells me that the real story behind why this accident occurred might be far more complicated than it appears.
Let’s dissect this a bit: It’s quite unusual for a driver, especially one towing a trailer, to blatantly run a red light unless there’s an underlying issue. Was the driver distracted, or perhaps was there a mechanical failure? These are important questions, and the answers could make big difference in the investigation.
It’s essential to consider the mechanical state of the F-350. Had it been properly maintained? Were the brakes checked regularly? If the investigation uncovers that the truck was poorly maintained, then the company responsible for its upkeep might share in the liability.
True, the F-350’s driver may seem primarily at fault, but it’s necessary for investigators to examine all contributing factors. While the driver’s actions are certainly a focal point, a thorough investigation must look beyond the obvious. It’s about piecing together all contributing factors to ensure all responsible parties are held accountable.
