Commentary by Attorney Michael Grossman

People may read the basic narrative provided in the news and think there’s little else to say. While the result is of course terribly sad, the basic story reads like someone just made an error in judgment.

Maybe that’s more or less all there is to what happened here, but decades in my line of work have taught me that important details too often slip through the cracks. Can police truly be certain of their conclusion, or was it simply “good enough” for them to move on? Will anyone take a closer look in search of anything unusual? For instance, did anyone evaluate the victim’s vehicle for defects or malfunctions? Did all its safety equipment (airbags, seat belts, brakes) work properly during the impact? If she hit the rear of the semi-trailer, was that just a timing issue or did the truck slow down unexpectedly? What did witnesses see? Did anyone check for sources of electronic data—cell phones, dashcams, surveillance footage, vehicle “black box” information—that could provide crucial evidence?

To be clear, I’m not saying things have to be more complex. I just believe that every accident, particularly a fatal one, deserves the respect of a careful investigation. I’ve seen many cases where a proper second look found crucial details that were ignored during the preliminary once-over. That man’s family deserves to have every one of their questions answered; will authorities make sure that happens?
