Commentary by Attorney Michael Grossman

Sometimes, authorities see icy roads involved in a crash, and they just chalk everything up to the weather. But it’s important with any serious accident to conduct a careful accident reconstruction. There could still be unique circumstances to consider.

For example, I rarely see authorities conduct their own inspection of a victim’s vehicle for potential defects. Common or not, they can happen, and they need to at least be ruled out. We had a case not long ago, for example, that involved a defective seatbelt authorities entirely overlooked. The driver was seriously injured when, had it not been for the defect, they likely would have been fine.

I’m not saying a defect happened here, but it’s an example of why investigations always need to be taken seriously. Whether authorities did so here remains to be seen.
