Austin, TX — October 26, 2024, TLeiya Morsell-Holmes, Tneal Holmes, and a child were injured in an alleged drunk driver accident at 9:08 p.m. on Burleson Road.

Preliminary information about the accident says that the accident happened in the area of the Emma Browning Road and Burleson Road intersection.

According to officials, 23-year-old TLeiya Morsell-Holmes, 30-year-old Tneal Holmes, and an 8-year-old were in a Jeep going eastbound on Burleson. While doing so, a Chevy Trailblazer reportedly crashed head-on into the Jeep. Another vehicle then crashed with the Chevy.

As a result of the collision, the child in the Jeep had reportedly serious injuries. TLeiya Morsell-Holmes and Tneal Holmes reportedly had moderate injuries. The Chevy driver was accused of being under the influence of alcohol, and they reportedly arrested that driver.

Anytime alcohol contributes to a crash, folks tend to think that makes things open-and-shut. That’s rarely true, though. While authorities may be quick to just file charges and move on, there could be more to the accident than just a reckless drunk driver. A lot of times, evidence will show that driver was unlawfully over-served by an alcohol provider. They, too, could face consequences for their actions.

Simply put, alcohol providers in Texas who over-serve someone that is obviously intoxicated can potentially face criminal investigations, fines, suspended licenses, and liability for injuries resulting from that intoxication. Not only does this help ensure those negligent alcohol providers are held accountable for their mistakes, it can provide an opportunity to put those establishments on the straight-and-narrow before their actions get more people hurt.

Too often, though, authorities let those negligent alcohol providers slip through the cracks. I’ve handled hundreds of cases against negligent alcohol providers, and a lot of them happened only after victims and families felt authorities weren’t giving them the whole story. It’s possible authorities here have been more prudent and were able to find out where this driver had been drinking. If they didn’t look into that, though, there could still be an accomplice to this crash who isn’t being held accountable.
