Commentary by Attorney Michael Grossman

When crashes like this one occur, people often assume they stem from a single moment of inattention or a misjudgment on the road. However, in my experience, accidents involving large commercial vehicles often demand a more thorough investigation to understand all the contributing factors.

Why did the Lexus collide with the rear-end of the 18-wheeler? Was it a matter of the passenger vehicle’s speed or driver reaction time? Did the truck’s right turn involve an unsafe maneuver, such as taking too much time or positioning itself improperly on the roadway? Investigating these questions will help clarify the sequence of events that led to the crash.

Another important factor to explore is whether the 18-wheeler’s equipment and operations contributed to the accident. Was the truck’s trailer properly lit and equipped with reflective markings to make it more visible, especially as it turned? Were its brake lights functioning as required? Additionally, it’s important to verify whether the truck was in compliance with state and federal regulations governing vehicle maintenance and operational safety.

Scrutiny should also extend to the trucking company itself. Companies are responsible for ensuring their drivers are qualified and properly trained, especially when it comes to executing turns on high-speed roadways like an expressway. Were there any operational pressures on the driver, such as tight delivery deadlines, that may have led to hasty or unsafe decisions? Exploring these elements could reveal whether broader issues within the company played a role in the crash.

Ultimately, the goal is to uncover the truth and provide clarity and closure to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those affected by the crash receive the answers they deserve.
