Commentary by Attorney Michael Grossman
Authorities have not released much information about this crash, but it deserves a top-notch investigation because it resulted in a man’s death. My experience in litigating vehicle accidents has taught me to look at three guiding questions.
1. Did the authorities thoroughly investigate the crash?
To fully understand the circumstances of this incident, investigators must address several key factors:
- Road conditions and infrastructure: Authorities should evaluate whether road had adequate signage, lighting or crosswalks to ensure pedestrian safety.
- Driver actions: While the driver showed no signs of impairment, authorities should confirm whether speed, distraction, or other behaviors played a role. Skid marks, eyewitness accounts and surveillance footage can help clarify the driver’s reaction time and actions leading up to the crash.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Potential mechanical or systemic issues in the Chevrolet Camaro should not be overlooked in the investigation:
- Braking system: Investigators should confirm whether the brakes were functioning properly and whether the driver attempted to stop before impact.
- Lighting and visibility: Was the vehicle equipped with adequate lighting to ensure visibility during daylight hours, particularly if shadows or glare were factors?
- Pedestrian detection systems: If the Camaro was equipped with advanced driver-assistance systems (ADAS), these should be evaluated to confirm they were functioning as intended.
A thorough inspection of the vehicle is necessary to rule out any mechanical or technological failures.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles and traffic systems can provide valuable data to help reconstruct the events leading up to the crash. Investigators should gather:
- Engine Control Module (ECM) data: The ECM may contain information about the vehicle’s speed, braking and steering inputs immediately before the collision.
- Traffic camera or surveillance footage: If available, video evidence can provide a clearer picture of the what happened in this accident.
- Infotainment and telematics logs: These may reveal if the driver was using in-car systems or distracted at the time of the crash.
- Cell phones: This is an often-overlooked source of data, but it can help investigators learn more about what was going on before the accident.
No investigation is perfect, but the victim’s family deserves answers to these questions. If authorities cannot provide them, perhaps the family should find an outside party to take another look at this case so no important details are missed.
