Commentary by Attorney Michael Grossman

It’s important to definitively determine if the driver who had been drinking was legally intoxicated. Not only might that call for harsher consequences for that driver, but it could also lead to investigations into where that alcohol came from. Here’s why that’s important.

In Texas, alcohol providers such as bars or restaurants can be responsible for contributing to an accident caused by a drunk driver they unlawfully over-served. If they serve someone who is obviously intoxicated, and that leads to people getting hurt, the victims and families involved can see those alcohol providers held accountable for their actions just as drunk drivers are held accountable for theirs.

Too often, this is something that goes overlooked, as authorities tend to get tunnel vision when there’s already someone to blame. Maybe investigations will show this all happened due to one person’s reckless actions. However, it wouldn’t be right for a wrongdoer to get off scot-free just because no one bothered looking for them.
