Commentary by Attorney Michael Grossman

When I see reports of a crash where a vehicle veers into oncoming traffic for no clear reason, I know many people assume it must have been due to distraction or a mistake by the driver. But experience has shown me that crashes like this are often more complicated than they first appear. Before drawing any conclusions, there are three critical questions that should always be asked to ensure a complete and accurate investigation.

The first question is whether authorities conducted a thorough investigation. When a vehicle crosses into opposing lanes, it’s important to determine why. Did the driver attempt to avoid something in the road? Were there signs of a sudden loss of control? Was the roadway designed in a way that contributed to the crash? Investigators should look at physical evidence like skid marks, vehicle debris and road conditions to understand the full picture. A surface-level examination may not uncover all the factors at play.

The second question, which is often overlooked, is whether a vehicle defect contributed to the crash. The Dodge Charger involved in this wreck could have experienced a mechanical failure — such as a steering issue, sudden acceleration or brake failure — that caused the driver to lose control. Dodge vehicles have been recalled in the past for electrical and powertrain issues, and if this Charger had an undiagnosed defect, that could be a key factor in the crash. The only way to determine this is through a forensic examination of the vehicle before it’s repaired or scrapped. Unfortunately, because people don’t always think to look for mechanical failures, crucial evidence is often lost.

The third question is whether all electronic data has been collected. The Charger’s engine control module could provide critical information about what happened in the moments before impact: whether the driver tried to brake, if there was a sudden change in speed or if the vehicle’s stability control systems activated. Additionally, surveillance footage from nearby businesses or traffic cameras could help confirm the sequence of events. And while authorities will likely check for driver distraction, phone data should also be examined to determine whether the driver was reacting to an unexpected road hazard. If this evidence isn’t secured quickly, it may be lost forever.

At the end of the day, a crash like this raises serious questions that deserve thorough answers. A proper investigation is the best way to ensure those affected understand exactly what happened and why. No one should be left with uncertainty when the tools to uncover the truth are available.
