Commentary by Attorney Michael Grossman

With a single-vehicle wreck like this, things can be a lot more challenging than people may realize. With the victim not here to give their side of the story, gathering clear evidence becomes more important than ever. Despite what folks may think, that’s not always something authorities are able to do on their own.

For example, I had this case not long ago where authorities blamed someone for not wearing their seatbelt. When we looked into why they believed that, it turned out it was just because the victim was thrown from their seat. Obviously, they thought, that only happens when someone isn’t using their seatbelt. Well, an independent accident reconstruction proved them wrong. It turns out the seatbelt had a defect that caused the pretensioner to fail. Authorities essentially blamed the victim for something they had no control over.

I’m not trying to suggest that happened here. I don’t know one way or the other. The point is that facts given after a preliminary crash investigation aren’t always as solid as people think. Further consideration into the evidence sometimes shows there’s much more to the story the victim’s loved ones deserve to know.
