Dallas, TX — December 16, 2023, Terry Ivory was killed as the result of an alleged drunk driving accident late Saturday off I-30.

Officials indicate the collision occurred at the intersection of the I-30 service road and Cockrell Hill Road, but the events ended in White Settlement.

According to current reports, police believe that 45-year-old Terry Ivory was walking on the service road when a driver struck him and killed him. That driver then allegedly continued driving—Ivory inside of the vehicle—all the way to White Settlement. Authorities say they found the suspect in the parking lot of a Jack in the Box after someone there called for emergency responders.

The driver apparently told authorities he thought he hit a deer. Police also said in a statement to the press that the driver smelled “like a brewery,” and he has been arrested on pending charges. Details about the suspect’s BAC are unavailable right now as investigations continue. But given these details, if true, I imagine the results will be quite high. As authorities have said to news outlets, those results could have a serious impact on additional charges.

Folks don’t always consider that something like BAC would matter so long as it’s over the legal limit, but it can make a huge difference for authorities and the victims and families involved.

For example, I’ve handled a lot of wrongful death cases against bars and other alcohol providers here in DFW which involved drunk drivers that were two, three, sometimes over four times the legal limit. Many of the servers involved in those cases were also in trouble with the authorities because the level of the drunk driver’s intoxication meant that server illegally over-served the drunk driver. That meant they could face charges, the establishment could be open to liability for the accident (which is often how my firm becomes involved in these situations), and even could have their liquor license taken away by the TABC.

That’s why I’m so concerned reading about this awful event. Police are saying this guy claims not to have realized he hit a person, then drove across the entire metroplex and was apparently still reeking of booze when police finally arrested him. I would frankly be shocked if a driver in that kind of condition wasn’t illegally over-served. Hopefully authorities are looking into where the alcohol came from so the victim’s loved ones know all those responsible for the victim’s death
