As much as folks assume pedestrian accidents are open-and-shut, they can present unique challenges. It’s not all about if someone was in a crosswalk or not. Sometimes, there can be extenuating circumstances.
For example, I handled a case not long ago involving a man who wandered onto a freeway where a car hit and killed him. The family wanted a second set of eyes on the investigations, and we caught something authorities overlooked. It turned out the man had been drinking at a local establishment, and the establishment unlawfully over-served the man to the point he was a danger to himself.
The man then responsibly chose to walk home rather than drive, but due to being over-served, he became disoriented and ended up walking into the roadway, ultimately killing him. What authorities had written off as a man being in the wrong place ended up being someone killed due to an alcohol provider’s negligence. Had it not been for the family just seeking some peace of mind, there’s no telling if the truth ever would have come to light.
Now, I’m not saying anything like that happened here. My point is simply that folks shouldn’t jump to conclusions or look for someone to blame. It’s important to let the evidence speak for itself, and these preliminary reports are likely far from telling the whole story.
