While there isn’t a lot of specific information about what happened here, posts from Harris County Constable officials led me to what seems to be images of the approximate location where this happened. If I’m looking at the right spot, it would seem the FedEx truck may have been at or going through a stop sign when this accident occurred. That raises serious concerns about who had the right-of-way and whether or not the truck driver was aware of their surroundings. Could a reasonably prudent, attentive professional driver have been able to avoid this?
What’s more, there seems to be a business right on the corner where the accident occurred. It’s possible that business has a security system which may have had a view of the accident. If that evidence does exist, it’s important steps are taken as soon as possible to secure it. Businesses generally don’t hang on to security video for very long, and it tends to be deleted or overwritten frequently. Reaching out to a business as soon as possible to secure that evidence can be crucial following a serious accident.
This isn’t just speculation. I was hired in a truck accident case recently where this exact issue came up. The reason I was hired was because the victim’s family was concerned the trucking company would repair a mechanical issue which they believed led to the accident that killed their loved one. They called me up on a Sunday night, and the first thing my staff and I did the next morning was alert the trucking company through a letter of spoliation. Essentially, this is a legal tool which informs someone who may have evidence critical to a case of their obligation to preserve that evidence. With that, we tracked down the truck and secured the evidence that same day.
I can’t know right now what would come up here if similar steps were taken. However, I do know that if the family in that case didn’t have someone securing evidence for them as quickly as we did, the evidence may have been lost. That would have left them with unanswered questions, which is the last thing any family needs following a serious accident.
However this particular incident turns out, the very least anyone deserves is clear answers. That’s why I have to wonder if anyone is considering the businesses and residences in the area and whether or not they have any evidence that can shed light on what happened here.
