As investigations continue, the difference between a work accident and a non-work accident are quite stark. Texas happens to have the most challenging work accident laws in the whole country. Despite what people may think, there isn’t always an automatic path for getting people benefits following a work accident. This means victims and families sometimes must prepare for a very tricky legal maze that requires a lot of evidence and legal strategy.
On the other hand, if someone is just in the area of construction and happens to be hit by a worker, that can involve other complex legal avenues. It could be that there premises issues the property owner or the work crew didn’t address, or this could be a case of negligent driving, which would involve a lot of similar challenges to traffic accidents involving commercial vehicles.
This is why it’s important steps are taken early to get clear details surrounding a crash. Knowing what happened is one thing, but knowing what comes next for those involved is also crucial. Victims and families can get the resolution they deserve, but they need to understand what the path to that resolution is going to require.
