Commentary by Attorney Michael Grossman

If reports have their facts straight about this accident, authorities think alcohol consumption may have been a factor. Toxicology tests appear to confirm that, but I don’t bring it up to judge or preach about the dangers of alcohol; this is a blog, not a soapbox. It’s simply an important detail to add for two reasons: First, because even unwelcome news is better than unanswered questions; second, because the investigation must now expand to find out where that alcohol came from.

Here’s why the alcohol’s source is important to learn: People may generally assume teenagers get alcohol from older friends or family, but experience has shown us there are definitely times where licensed alcohol providers serve underage customers. Some establishments are too lazy to ID customers, and others simply don’t care about breaking the law. Both are hazardous to their communities, and both need harsh lessons about getting their house in order.

I’ve worked on hundreds of cases against negligent alcohol providers responsible for contributing to serious accidents. The ones who engaged in behavior as low as serving minors were usually breaking all kinds of laws, and they only cleaned up their act once they were confronted and held accountable for their actions. That’s why the possibility that alcohol contributed to a young driver’s death is so concerning and so urgently needs further investigation. At the very least his loved ones deserve the whole story; anything beyond that would depend on what that story is.
