Commentary by Attorney Michael Grossman

A lot of the time when a seemingly open-and-shut crash occurs, people make the mistake of assuming the authorities will get them all the evidence they need. Assuming this without confirming it, though, only risks letting crucial evidence deteriorate or slip through the cracks. Let me explain.

Authorities have a lot on their plates, and accident reconstruction often takes a back seat. For victims and families affected by a crash, they need as much clear evidence telling their side of the story as possible. That can prove challenging if they receive an incomplete picture or end up with inaccurate reports because they waited around for investigations that weren’t being taken seriously to begin with. Without clear evidence on their side, those looking to avoid responsibility may have ample room to shift the blame and muddy the waters.

That’s why I’ve always found it wise to follow up with authorities with any concerns or questions folks may have. If authorities address their concerns thoroughly, that’s good. If their answers come up short or leave doubts, then victims and families can seek out a second opinion to make sure they’re not missing anything important.
