Caldwell County, TX — November 19, 2023, Tania Martinez Borja, Abel Enciso, and three others were hurt after an alleged drunk driver accident along F.M. 1854.

Preliminary statements released by authorities say that the crash occurred near the intersection of F.M. 1854 and Garcia Lane, southeast of Mustang Ridge.

According to officials, 28-year-old Tania Martinez Borja and 34-year-old Abel Enciso, along with three children, were in a Hyundai Elantra going southbound on F.M. 1854. From oncoming lanes, authorities say that a northbound Chevy Silverado went left of center and crashed into the Hyundai.

As a result of the collision, Martinez Borja, Enciso, and all three kids in the car had reportedly incapacitating injuries. The driver of the Silverado, a 19-year-old, also had incapacitating injuries.

Authorities allege that the teen driver admitted to drinking up to 20 beers prior to the accident. If that’s true, then I hope they’re also looking into where that alcohol came from.

Needless to say, someone who’s underage can get alcohol from all kinds of places. Oftentimes, it’s from a friend or family member who’s older. But a real concern is the possibility a local business sold the alcohol to them. As much as people may think fake IDs are to blame, that’s unfortunately not the reason in many situations.
For example, I’ve litigated hundreds of personal injury cases against bars, restaurants, liquor stores, and other businesses for over-serving someone and contributing to a drunk driving accident. Since those establishments have no problem breaking one law, they often have no issues breaking others, and knowingly selling alcohol to minors is a lot more common than people may think.

So is that what happened here? Is the allegedly drunk driver entirely to blame, or did someone out there help them in nearly causing a fatal crash? Hopefully authorities are wondering the same thing.
