Commentary by Attorney Michael Grossman

Considering this is just about the peak time for drunk driving (second only to Saturday night into Sunday morning), have authorities found out where this alleged drunk driver was coming from? In Texas, alcohol providers can also be in serious trouble if they contribute to a serious accident. It’s illegal for them to over-serve someone who is obviously intoxicated. If they do so, they can face criminal investigations, fines, license suspensions, and even liable for resulting injuries.

Unfortunately, this is not often a high priority for the authorities. I’ve handled hundreds of cases against negligent alcohol providers, and more often than not those establishments only get on the authorities’ radar because we brought the evidence we uncovered to the authorities on a silver platter. Even then, they sometimes will just move on once they’ve charged the drunk driver. Simply put, people don’t want an easy explanation or some bad guy to point their finger at. They want to see accountability, and that’s why I have to wonder if there are steps being taken in that direction here.
