Commentary by Attorney Michael Grossman

There are many reasons someone may be detained after an accident, and it’s possible it was all just standard procedure for the investigation. Of course, if there were more serious reasons, that could create unique challenges for a family affected by a fatal accident.

For example, Texas and Arkansas have similar laws concern drunk driving accidents and the possibility of a complicit negligent alcohol provider. If evidence shows someone who caused a drunk driving accident was unlawfully served prior to the accident, the alcohol provider could be responsible for contributing to the resulting accident.

Perhaps nothing like that happened here, but it’s one of the reasons simply waiting around for authorities isn’t always the best step forward. Sometimes, it’s best to find experienced allies who have particular tools and training to handle the complex legal avenues that may lie ahead.
