Commentary by Attorney Michael Grossman

Generally speaking, people are hasty to assume single-vehicle wrecks can’t ever be the result of something a driver had no control over. It is true that driver error is the most common cause, but there are other possibilities that cause accidents plenty. Unfortunately, even authorities can be quick to dismiss those factors without actually looking at the evidence.

Mechanical defects, road hazards, road design flaws, tire blowouts—when authorities fail to consider these possibilities, it inevitably leads to important details slipping through the cracks, and someone ends up blamed for something they couldn’t control. Maybe that isn’t what happened here, but I see no reason why this crash doesn’t deserve as much scrutiny as any other serious accident. Jumping to conclusions certainly isn’t going to do any good.
