Commentary by Attorney Michael Grossman

News releases about this crash used fairly imprecise language, so it’s not clear if the victim was operating the motorcycle or riding on the back as a passenger—and that’s just the start of the details that need clarifying through a thorough investigation. I just hope that’s what this crash gets.

Little as I like saying this, motorcycle accidents don’t always get a fair shake from the public—and worse, from authorities. Even though most of them are keenly aware they have to be extra careful, people tend to dismiss anyone on a bike as a daredevil and hand-wave away any accidents they’re in as self-inflicted. Those troubling biases are much worse when they come from investigating officers, as allowing that to affect their efforts can mean their reports leave things out or get events totally wrong.

To be clear, I’m not saying people on motorcycles are wholly above scrutiny. They can make mistakes the same as anyone else, and those mistakes often cost them a great deal. However, just like any other accident, the right thing to do is let evidence speak for itself. I just hope before all is said and done that authorities can find some real answers for that woman’s loved ones.
