Police allege that the Ford driver was under the influence of alcohol at the time of the accident. It’s unclear if authorities filed charges, though they usually do when it comes to drunk driving. It may surprise people, though, that authorities often let an accomplice slip through the cracks: the alcohol provider that served the drunk driver.

To put it simply, it’s illegal in Texas to over-serve someone who is obviously intoxicated. Doing so can expose an establishment to criminal investigations, fines, license suspensions, and even liability when their actions lead to people getting hurt. But most of the time, once authorities have charged a driver, they simply move on. I can’t count how many times our firm has investigated a negligent alcohol provider’s role in a client’s injuries, and authorities were no where to be found. It’s just not that high of a priority for a lot of departments despite how important it is those alcohol providers face consequences and clean up their act. Maybe that wouldn’t apply to this specific accident, but I wonder if investigators are even looking into it as a possibility.
