Commentary by Attorney Michael Grossman

When incidents like this occur, many people may focus on immediate factors such as the apparent cause of the crash—in this case, high winds. While weather can undoubtedly contribute to accidents, my experience handling commercial truck cases has shown that the underlying factors often go much deeper. A comprehensive investigation is necessary to uncover whether the accident was truly unavoidable or if preventable issues played a role.

One critical question is whether the truck itself was prepared for adverse conditions. High winds pose a significant hazard to large trucks, particularly when they are carrying light or empty trailers. Investigators should determine whether the trailer’s weight, balance, or loading played a role in the truck’s instability. Additionally, examining whether the truck’s tires, brakes, or steering systems were in good working order will be vital to assess whether mechanical factors contributed to the crash.

The trucking company’s policies and practices must also be examined. Did the company dispatch the truck knowing that high wind warnings were in effect, and if so, what guidance did they provide to the driver? Were the driver’s routes, schedules, or decisions influenced by company pressure to meet deadlines, even at the risk of driving in unsafe conditions? If the company failed to prioritize safety, its role in the wreck must not be overlooked.

Ultimately, the goal is to uncover the truth and provide answers to those affected by this crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure that those impacted by the incident receive the clarity and closure they deserve.
