Commentary by Attorney Michael Grossman
When accidents like this happen, people often assume they result from simple driver error. However, based on my experience, crashes involving large trucks frequently have more complex causes that require a thorough investigation.
Given the circumstances, it’s essential to examine what might have led to the truck swerving out of its lane. Factors such as mechanical failure, driver fatigue, or other external influences should be considered. It’s also important to investigate whether the truck was properly maintained and whether the driver adhered to all safety protocols, including hours-of-service regulations. These aspects are crucial in understanding how and why the accident occurred.
Truck maintenance is a critical aspect of safety that cannot be overlooked, especially when it comes to large commercial vehicles. Proper maintenance ensures that all parts of the truck—from the brakes and tires to the engine and steering—are functioning correctly and are less likely to fail at a crucial moment. Inadequate maintenance can lead to mechanical failures, such as brake malfunctions or tire blowouts, which can have catastrophic consequences on the road. Regular inspections and prompt repairs are essential in preventing accidents like this one, where a failure to maintain the vehicle might have played a role in the crash.
If the truck involved was operating under a commercial trucking company, there could be additional layers of responsibility. The company’s practices regarding vehicle maintenance, driver training, and safety enforcement could play a significant role in the events leading up to the crash. Any lapses in these areas might have contributed to the accident.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
