Commentary by Attorney Michael Grossman

When a motorcycle crashes while allegedly evading police, the circumstances of the pursuit itself become a critical part of the investigation. In my experience, it’s important to examine whether law enforcement followed proper procedures, whether external factors contributed to the loss of control, and whether all available evidence has been gathered to provide a full account of what happened.

Did authorities conduct a thorough investigation into both the crash and the pursuit leading up to it? Reports indicate the motorcycle failed to negotiate a curve while fleeing from police, but they don’t explain why. A proper investigation should determine whether the pursuit was conducted in accordance with department policies and whether the risk of continuing the chase outweighed the need to apprehend the rider at that moment.

Could a mechanical failure or road condition have played a role? A motorcycle struggling to navigate a turn could be the result of excessive speed, but it could also stem from a brake malfunction, tire failure, or hazardous road conditions. Investigators should examine whether the roadway was in good condition and whether any mechanical issues might have contributed to the loss of control.

Has all available evidence, including video footage, been gathered? If police were actively pursuing the motorcycle, dashcam or body-worn camera footage could provide important context about the events leading up to the crash. Additionally, nearby traffic or security cameras might offer a clearer picture of what occurred. Without this evidence, critical details could be overlooked.

Accidents like this, where two people suffered serious injuries in the course of a police pursuit, demand careful investigation to ensure all contributing factors are properly examined. Addressing these questions helps provide a full understanding of what happened and why. A thorough investigation is the least that can be done to provide clarity and closure for those affected.
