Commentary by Attorney Michael Grossman
When I read about a crash like the one in Tarrant County that left a woman seriously injured, many might assume it was simply a case of driver error. However, without a thorough investigation, it’s impossible to say for sure what really happened. That’s why it’s important to ask the right questions to ensure all potential factors are examined.
First, did the authorities conduct a thorough investigation? Single-vehicle crashes are often treated as straightforward incidents, but that can lead to critical details being overlooked. Did investigators examine the crash site for potential hazards like poor road maintenance, debris, or unclear signage? Were there any witnesses or nearby security cameras that could provide additional context? A complete investigation should go beyond assumptions and seek to establish the full story.
Second, has anyone looked into whether a vehicle defect played a role? Mechanical failures such as brake malfunctions, power steering issues, or unintended acceleration can sometimes cause drivers to lose control. Even if no obvious mechanical problems were noted at the scene, a professional inspection of the vehicle could reveal issues that might not be immediately apparent.
Lastly, have investigators gathered all available electronic data? Many modern vehicles contain event data recorders that store crucial information about speed, braking, and steering in the moments before a crash. Retrieving and analyzing this data could help determine whether the driver attempted to avoid something in the roadway or if a sudden mechanical failure occurred. Nearby traffic cameras or surveillance footage could also provide valuable insight.
At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
