Commentary by Attorney Michael Grossman

When single-vehicle accidents result in serious injuries, it’s essential to look beyond initial assumptions and examine all potential contributing factors. Based on my experience, thorough investigations should always address three key questions: Was the accident thoroughly investigated? Could a vehicle defect or maintenance issue have played a role? And has all relevant electronic data been collected?

Was the accident thoroughly investigated? Single-vehicle accidents are often presumed to be caused by driver error, but many other factors may contribute. Was the roadway poorly lit, slick, or uneven? Did weather conditions, such as rain or fog, affect visibility or traction? Did external factors—like a stray animal or debris on the road—cause the driver to swerve? Investigators must carefully document the scene to ensure that no detail, however small, is overlooked.

Could a vehicle defect or maintenance issue have played a role? Modern vehicles like the Toyota Tundra are equipped with advanced safety systems, but mechanical failures or defects can still occur. Were the brakes and steering systems in proper working order? Were the tires in good condition and properly inflated? These questions can only be answered by conducting a thorough inspection of the vehicle to rule out or identify any mechanical issues that may have contributed to the crash.

Has all relevant electronic data been collected? Many vehicles today are equipped with event data recorders (EDRs) that can provide crucial information about the moments leading up to an accident. This data might include speed, braking, steering inputs, and other key details that could help reconstruct what happened. Additionally, any available dashcam footage, surveillance video, or witness accounts should be sought to provide a fuller picture of the events.

Accidents like this one on State Highway 95 demand a meticulous investigation to uncover every contributing factor. Addressing these questions can provide understanding about what happened and why. For the two individuals who were seriously injured, obtaining answers is a vital step toward clarity and closure.
