UPDATE (January 23, 2025): Recent reports have been released which clarify what occurred leading up to and during this accident. According to these reports, 18-year-old Shayanne Cicherski, a 16-year-old boy, and a 13-year-old boy were traveling in a southbound Hyundai Elantra on Wood Road approaching the U.S. Highway 2 intersection when the accident took place. Officials indicate that, for as yet unknown reasons, the Elantra failed to yield the right-of-way to highway traffic at a stop sign, entering the intersection at an apparently unsafe time. This led to a collision between the Elantra and the 18-wheeler’s trailer. All three people from the Hyundai were transported to area medical facilities. However, the 16-year-old was reportedly unable to overcome his injuries, having later been declared deceased. No additional information is currently available. Investigations continue.

Commentary by Attorney Michael Grossman
Accidents like this one highlight just how complex the aftermath of a crash involving a large commercial vehicle can be, particularly when the details surrounding the collision raise significant questions about accountability. Based on the updated reports, it seems the driver of the Hyundai Elantra may have failed to yield at a stop sign, entering the intersection at an unsafe time and colliding with the 18-wheeler’s trailer. While this explanation seems to assign blame to the passenger car, it’s rarely as simple as it might first appear.
From my experience with commercial vehicle cases, understanding what truly happened requires a thorough investigation. Why did the Elantra fail to yield? Was the stop sign visible and unobstructed? Were distractions, speed, or visibility factors? Was the 18-wheeler operating within its lane, adhering to speed limits, and in compliance with its own safety obligations? While it’s easy to focus on the immediate actions of the smaller vehicle, the role of the truck and its operator must also be carefully examined to determine if any additional contributing factors exist.
It’s also critical to evaluate the condition of the truck and trailer itself. Federal regulations require commercial vehicles to be equipped with functioning lights, reflectors, and other safety features to ensure visibility. Was the truck’s trailer appropriately visible as it crossed the intersection, particularly if the lighting or weather conditions were less than ideal? Similarly, trucking companies must routinely inspect and maintain their fleets to ensure compliance with these safety standards. Any failure to do so could prove to be a significant factor in the accident’s outcome.
Finally, the responsibility of the trucking company overseeing the operation of the 18-wheeler cannot be overlooked. Were the truck driver’s actions consistent with proper training and protocols? Did the company encourage unsafe driving behaviors, such as pressuring drivers to meet delivery deadlines at the expense of safety? Ensuring that the company adhered to its legal responsibilities is a crucial step in determining the full scope of liability.
Ultimately, a thorough investigation is the least that can be done to ensure all the facts are uncovered and accountability is determined. Even if it requires independent investigation, it’s only through such careful means that those affected by this incident—especially the family grieving the loss of the young passenger—can receive the clarity and closure they deserve.
