Commentary by Attorney Michael Grossman

Crashes like this can be particularly complex due to the fact the victims likely weren’t in a good spot to tell their side of the story. One person, in fact, isn’t around anymore. This makes it absolutely vital to conduct thorough investigations to let the evidence speak on their behalf. The challenge, though, is authorities don’t always do that.

I’ve been in this line of work for over 30 years. I’ve simply lost county of how many serious car accidents have come across my desk with shoddy or incomplete preliminary investigations. Not every department prioritizes car accident reconstruction. This can leave skilled and dedicated officers unable to do their properly, since they may not have the right tools or the time they need to be thorough.

This is why a prudent first step is for families to bring their concerns and questions to the authorities as soon as they can. Did they pull cell phone records? Did they map out the scene? Did they pull electronic data from the vehicles? Have they canvassed nearby homes or businesses for possible camera footage? Have they inspected the vehicles for defects? If authorities have clear and satisfactory answers, it’s likely their investigations have been thorough. If their answers fall short, though, it could be that the crash needs another set of eyes looking things over to ensure nothing important slipped through the cracks.
