Commentary by Attorney Michael Grossman

After an accident like this I often have to contend with two mistaken beliefs that are at odds with one another: Some folks believe pedestrians always have the right-of-way, while others think they essentially never do outside of a light-protected crosswalk. The law is seldom so cut-and-dried as either of those beliefs suggest, however, and the overall circumstances of any accident must be considered.

Here are some details that still need to be clarified: How fast was the vehicle traveling? How long was the victim in the roadway before the vehicle approached? Could or should the driver reasonably have seen her in the road while approaching? How well-lit is that area at night? Was the driver’s full attention on their surroundings? Did anyone look at their phone records? Where did both the driver and the pedestrian come from before the collision?

That’s only a handful of the many questions that still need answers to get a proper handle on what happened. The point isn’t to make things more complicated, just to ensure they’re fully understood. At the very least it’s important to round up every available answer for the victim’s loved ones. If there are any other steps, they depend on what those answers turn out to be.
