Guadalupe County, TX — July 16, 2024, Shannon Curtis was injured following an alleged drunk driver accident at around 7:00 p.m. along F.M. 1103.

Authorities said in preliminary investigations that the crash took place in the area of F.M. 1103 and Green Valley Road.

Investigators said that 39-year-old Shannon Curtis was in a Ford Explorer going on southbound F.M. 1103. While Curtis was stopped at the intersection with Green Valley Road, a Chevy Tahoe crashed into the back of Curtis’s vehicle. As a result, Curtis sustained serious injuries.

The other driver involved was allegedly under the influence of alcohol at the time. Authorities recommended charges for driving while intoxicated.

Frankly, I’m used to seeing accidents like this result in more serious charges. Perhaps there are mitigating circumstances authorities didn’t discuss publicly. Or, it could be further charges are still pending investigations. Believe it or not, drunk driving accidents can be incredibly complex. It’s not always as simple as just seeing an intoxicated driver behind bars.

For example, I had a case not long ago where a drunk driver hit a family’s car, nearly killing a young boy. While authorities were quick to charge the driver, they overlooked something crucial: a local bar illegally over-served the driver. Our investigations found the bar continued serving the man well beyond the point he was a clear danger to others due to his intoxication. Still, servers continued giving him drinks, and he could barely walk to the bathroom without falling over. Once the family saw this, they were shocked that authorities never bothered with their own investigations. Had it not been for them seeking out a second set of eyes from someone who happened to have decades of experience holding negligent bars liable for their role in serious accidents, that bar may never have faced consequences.

Unfortunately, this is a pretty common scenario. Authorities tend to have a narrow scope when it comes to seeing there are appropriate consequences after a drunk driving accident. That’s why the apparent lack of strong charges here is a red flag to me. Like I said, there could be more to this story that just isn’t publicly available right now. But it’s also possible there is more to this story that even authorities overlooked.
